NON MANDITORY VIOLATIONS
Non-mandatory means your violation doesn’t require you to appear before the judge to resolve it. We have 4 options for you to choose to take care of your violation.
1) Pay to Close Option: Non-mandatory violations have the option to pay to close the case. The State Uniform Fine Schedule sets the fine amount including when an accident, delinquent and warrant fees should be added. Please be aware that when you pay to close on a moving violation, points may be added to your driving record. 2) State Court Option: The Utah State Court provides an option to resolve citations that meet specific qualifications. You MUST apply with in 21 days of the citation. The court can not provide any extensions on the time frames for this program.
The Deferred Traffic Prosecution is a statewide option that allows for the dismissal of qualifying charges after completion of specific terms and conditions. You must hold a Utah driver's license (No CDL) and be 21 years of age or older to apply. If you would like the Deferred Traffic Prosecution, please do not pay the citation first. Wait until you are directed to pay. This allows for the correct information to be reported to the driver's license division based upon your choice.
3) Traffic Plea in Abeyance: This option is based upon eligibility. Typically those with a good driving record qualify. Please be aware the CDL holders do not qualify and should not apply for the Traffic Plea in Abeyance. The judicial assistant won't be able to approve you if your citation involves the following: alcohol related offense, reckless driving, speeding 20+ on an Interstate, speeding 15+ anywhere other than the interstate, or mandatory violations that require an appearance before the judge. You must not have prior pleas in abeyance for a moving violation or moving violation citations on your driving record within two years from the date of the offense. The court does require a copy of your driving record from the Drivers License Division. That can be brought into the court in person at 80 W 50 S, Willard, UT 84340 or emailed to [email protected]. If you qualify for the Traffic Plea in Abeyance an agreement form will given to you to sign. If you have lived in a different state within the last two years a driving record from both states is required.
Terms and Conditions for the Traffic Plea in Abeyance:
a) Defendant agrees to pay the recommended fine as constrained in the Utah Uniform Fine Schedule Plus an additional $25 Plea fee which will be due at the time of the agreement.
b) Defendant agrees to have no convictions for any moving violation(s) in any state for the duration of this agreement
c) The length of this agreement shall be in place for 6 months from the date of the signed agreement.
If you are able to complete the agreement for the 6 months the case will be dismissed. If a moving violation is received within the 6 months a guilty plea with go on the citation.
4) Contesting a Citation: If you wish to contest your citation call into the Justice Court at (435) 723-2634 to schedule a hearing.
